Terms and Conditions of Sale – PetBoutique

Welcome to PetBoutique. This document governs the use of our store and the legal relationships between Rapan S.R.L. and its Users. By accessing the site and completing a purchase, you fully accept the conditions set forth here.

1. Information about the Owner

2. Scope of Application

The use of PetBoutique is reserved for adult Users. If you act as a "Consumer" under the Consumer Code, you enjoy all protections provided by European law. If you act as a "Professional User" (purchase with VAT number), the rules of the Italian civil code will apply.

3. User Account and Registration

It is possible to purchase as a "Guest" or by creating a personal account.

  • Responsibility: The user is responsible for the confidentiality of their credentials.

  • Security: If you suspect unauthorized access, you are required to immediately inform the Owner.

  • Closure: You can close your account at any time by contacting our support.

4. Purchases and Ordering Procedure

  • Product Description: The images are for illustrative purposes only. We strive for maximum color accuracy, but shades may vary depending on monitors (especially for items like Barbour or artisanal fabrics).

  • Conclusion of the Contract: The contract is considered concluded when you receive our "Order Confirmation" email.

  • Prices: All prices include VAT. Any customs duties for shipments outside the EU are the customer's responsibility.

5. Payments and Retention of Title

We accept the main payment systems (PayPal, Stripe, Cards, Apple/Google Pay, Installments).

  • Security: Payment data is managed exclusively by service providers (e.g., Stripe/PayPal) and does not pass through our servers.

  • Ownership: Products remain the property of Rapan S.R.L. until full payment of the price.

Upon delivery, please check the package's integrity and immediately report any visible damage to the courier.

7. Right of Withdrawal, Returns and Refunds

8. "Word of Mouth" Program and Discount Vouchers

  • Vouchers: Discounts are not cumulative, unless otherwise indicated.

  • Usage: Discount codes must be entered at checkout; they cannot be applied after the order has been submitted.

  • Validity: The Owner reserves the right to cancel vouchers obtained through fraudulent activities or bots.

9. Intellectual Property Rights

All content on PetBoutique (texts, product descriptions "Concept Store", graphics, logos) is the exclusive property of Rapan S.R.L. or its licensors (e.g., Barbour, Tavo). Copying, even partial, of the content without written authorization is prohibited.

10. Limitation of Liability

The Owner is not responsible for any delays or failures due to force majeure or errors entered by the user during the order phase (e.g., incorrect address). We commit to keeping the service accessible 24/7, except for necessary maintenance.

11. Applicable Law and Jurisdiction

These Terms are governed by Italian law. For any dispute with a Consumer, the competent court is that of the user's residence. For Professional Users, the exclusive court is that of Vicenza.

12. Right of Withdrawal (Integration)

The Consumer has the right to withdraw from the contract within 14 days from physical possession of the goods.

  • Procedure: To exercise the withdrawal, explicit communication via email to info@petboutique.it is required. You can use the standard form provided at the bottom of this page.

  • Effects: The refund includes the product price and standard delivery costs. Direct costs for returning goods are borne by the User.

  • Exceptions (Important): The right of withdrawal does not apply in the following cases selected by PetBoutique:

    1. Sealed products that cannot be returned for hygienic reasons or related to health protection (e.g. shampoo, hygiene products opened after delivery).

    2. Food products (e.g. Farmina) that risk deteriorating or expiring quickly.

    3. Custom-made or personalized products.

13. Legal Warranty of Conformity

All products sold to Consumers on PetBoutique are covered by the legal warranty of conformity of 24 months provided by the Consumer Code.

  • The seller is liable for any conformity defect existing at the time of delivery of the goods.

  • In case of defect, the User is entitled to the restoration of conformity (repair or replacement) or, alternatively, to a price reduction or contract termination.

14. Limitation of Liability and Indemnity

  • Use of the Service: The User agrees to indemnify Rapan S.R.L. from any claim arising from improper use of the site or violation of these Terms.

  • Damages: Except in cases of willful misconduct or gross negligence, PetBoutique is not responsible for indirect damages or data loss resulting from the use of the site. We do not guarantee that the service will be uninterrupted or free from minor technical errors.

15. Intellectual Property

All trademarks, logos, illustrations, and texts on PetBoutique (including the brands Barbour, Tavo, Aries, Liu Jo) are the exclusive property of their respective owners. Reproduction, sale, or exploitation of the content without written authorization is prohibited.

16. Dispute Resolution (ODR)

In case of disputes, PetBoutique invites the User to seek an amicable settlement by contacting our Customer Care within 7 days of the issue.

  • ODR Platform: European Consumers can use the European Commission's platform for online out-of-court dispute resolution, available at http://ec.europa.eu/consumers/odr/.

17. Changes to the Terms

Rapan S.R.L. reserves the right to modify these Terms to adapt them to new product offers or legislative changes. Continued use of the site implies acceptance of the new conditions.
